Terms of Use

1. Agreement to these terms

These Terms of Use ("Terms") are a contract between you and HouseHeist® ("HouseHeist," "we," "us," or "our"). They apply when you visit this site, register for HouseHeist Live or any other training or event, watch a replay, book a call, or use anything else we offer through this site (together, the "Services"). If you do not agree to these Terms, please do not use the Services.

You must be at least 18 years old to use the Services. Please also read our Privacy Policy, which explains how we handle your information.

2. What we offer

HouseHeist Live is a free live training about finding, analyzing, funding, and closing real estate deals. We may also offer replays, emails, calls, and paid programs. We can change, pause, reschedule, or end any training, date, time, topic, or speaker at any time, for any reason, without notice.

3. Education only. Not advice.

Everything we say, show, or send is for education and information only. It is general in nature and is not made for your personal situation. Nothing in the Services is:

• investment, financial, legal, tax, accounting, insurance, or lending advice;
• a recommendation to buy, sell, finance, or hold any property or security;
• an offer to sell you a security or an investment; or
• real estate brokerage services or an appraisal.

Some of our hosts and guests hold professional licenses. Nothing in the Services is given in that role. No attorney-client, adviser-client, broker-client, fiduciary, or similar relationship is created by your use of the Services, by asking us a question, or by sending us a property to review.

Before you make any real estate or money decision, talk to your own licensed attorney, tax professional, lender, real estate professional, and financial adviser.

4. No promises about results

We do not promise or guarantee that you will make money, find a deal, get funding, or get any result at all. Any numbers, deals, examples, or stories we share are to teach a point. They may be simplified, hypothetical, or from one person's experience. They are not typical and do not predict your results.

What happens for you depends on many things we do not control, including your effort, time, money, skill, credit, market, and luck. Many people who take real estate training do not make money. Past results, ours or anyone else's, do not guarantee future results.

5. Real estate investing is risky

Real estate investing can lose money, including all of the money you put in and, in some cases, more than that. Prices, rents, costs, interest rates, laws, and markets change. Rehab projects go over budget and over time. Deals fall apart. You are fully responsible for your own due diligence and for every decision you make and every dollar you spend.

6. Registering and joining live sessions

When you register, you agree to give us true and current information. Your training link is for you only. Please do not share it, post it, or sell it. We may remove anyone from a session, or block access to the Services, if we believe they broke these Terms or are disrupting the event.

We do not promise that a live session will start on time, run without problems, or be available on every device. Zoom and other third-party tools can fail. If that happens, we may reschedule or send a replay, but we are not responsible for lost time or costs.

7. Recording

We may record live sessions, including the chat and Q&A, and may share or reuse the recording or pieces of it. By joining a session, you agree that we may record and use your name, voice, image (if you turn on your camera), questions, and comments. If you do not want to be recorded, do not turn on your camera or microphone and do not post in the chat. You may not record, copy, or share any session yourself without our written permission.

8. Live property reviews and Q&A

We may choose to look at a property or deal that an attendee sends us. This is optional, for teaching, and is not a promise. We do not promise to review any property, and we may show the address and details to the audience. Only send properties you are free to share. Do not send private information about other people, and do not send money, bank or card numbers, Social Security numbers, or passwords.

Anything we say about a property is our opinion on the facts we were given in the moment. It is not an appraisal, inspection, underwriting decision, or advice to buy, renegotiate, or walk away. You must check every fact yourself. We are not responsible for any decision you make based on a live discussion.

9. Email and text messages

By registering, you agree to get emails from us about the training and our other programs. You can unsubscribe at any time using the link in any email. If you choose to get text messages, message frequency varies, message and data rates may apply, and you can reply STOP to cancel or HELP for help. Agreeing to texts is not required to join any training or to buy anything.

10. Paid programs and sales calls

The free training and these Terms are not an offer of a paid product. If you choose to buy a paid program, course, service, or other product from us, it will come with its own written terms, price, and refund policy that you will see before you pay. If those terms conflict with these Terms, the paid program terms control for that purchase. A call with us is not a promise that you will be offered, or be approved for, anything.

11. Testimonials and stories

Stories, examples, and statements from our team, guests, or students are individual experiences. They are not typical, and we do not promise you will have the same experience.

12. Our content and trademarks

HouseHeist®, Real Heist™, HouseHeist University, the HouseHeist docuseries, and all training, videos, slides, text, images, logos, and other materials in the Services belong to HouseHeist or its licensors and are protected by law. We give you a limited, personal, non-transferable permission to view them for your own learning. You may not copy, record, sell, share, post, teach, or use them to build a competing product or service without our written permission.

13. What you send us

If you send us a question, comment, idea, or other content, you give us a free, permanent, worldwide right to use it, edit it, and share it in any way, with or without your name, and you promise you have the right to send it. We do not have to use it or pay you for it.

14. Rules for using the Services

You agree not to:

• break any law or the rights of others;
• give false information or pretend to be someone else;
• harass, threaten, spam, or sell to other attendees, or post harmful, hateful, or illegal content;
• try to hack, disrupt, scrape, or overload the site or any live session;
• use the Services to promote your own products or services without our permission; or
• share or resell access to any session, replay, or material.

15. Third-party sites and tools

The Services may use or link to tools and sites run by others, like Zoom, YouTube, Facebook, and Kajabi. We do not control them and are not responsible for them. Your use of them is under their own terms and policies.

16. No warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO PROMISES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ABOUT ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT PROMISE ANY FINANCIAL, BUSINESS, OR INVESTMENT RESULT.

17. Limit on our responsibility

TO THE FULLEST EXTENT THE LAW ALLOWS, HOUSEHEIST, ITS OWNERS, HOSTS, GUESTS, EMPLOYEES, CONTRACTORS, PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SAVINGS, DATA, OR BUSINESS OPPORTUNITY, OR ANY LOSS FROM A REAL ESTATE OR OTHER INVESTMENT DECISION, EVEN IF WE WERE TOLD THIS COULD HAPPEN. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT BE MORE THAN THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some places do not allow these limits, so some of them may not apply to you.

18. You will cover us

You agree to defend, protect, and pay for any claim, loss, or cost (including reasonable attorney fees) that comes from your use of the Services, your decisions or actions based on them, what you send us, or your breaking these Terms or the law.

19. Which law applies and how we solve problems

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. Before filing any claim, you agree to email us at [email protected] and give us 30 days to try to work it out. If we cannot, any lawsuit must be brought in the state or federal courts located in Jefferson County, Alabama, and you agree to their authority. Each of us agrees to bring claims only on our own behalf and not as part of a class action, to the extent the law allows.

20. Changes and ending access

We may update these Terms at any time by posting the new version here with a new date. Using the Services after a change means you accept it. We may suspend or end your access at any time, for any reason. Sections that by their nature should continue (like 3 through 5, 7, 12, 13, and 16 through 19) will continue after your access ends.

21. The fine print

If a part of these Terms cannot be enforced, the rest still applies. If we do not enforce a part of these Terms, that does not mean we give it up. You may not transfer your rights under these Terms. We may. These Terms, together with our Privacy Policy and any written terms for a paid program you buy, are the whole agreement between you and us about the Services.
